1. Introduction
1.1 These Terms & Conditions apply where a guest chooses to use the Emirates Delivers international delivery service in connection with purchases made at Bicester Village.
1.2 References to “Bicester Village”, “we”, “us” or “our” mean Value Retail Management (Bicester Village) Limited, acting on behalf of the Bicester Village group.
1.3 References to “Emirates Delivers” mean the international delivery service operated by Emirates, which is a third party service provider.
2. Nature and Scope of the Service
2.1 Bicester Village’s involvement in the Emirates Delivers service is strictly limited to facilitating the collection and transfer of purchased goods from Bicester Village to the Emirates Delivers UK warehouse.
2.2 All international shipping services, including (without limitation):
• export and import arrangements, • customs clearance, • calculation and payment of duties and taxes, and • onward international delivery,
are provided exclusively by Emirates Delivers and are outside the control of Bicester Village.
2.3 Bicester Village does not act as carrier, freight forwarder, customs agent or bailee in relation to international delivery. Bicester Village is not responsible for, and assumes no liability in connection with, any inspection undertaken by Emirates, customs authorities, security agents, or other governmental bodies.
2.4 Guests acknowledge that by using the Emirates Delivers service they appoint Emirates, and Emirates accepts appointment, as their agent for the purposes of receiving, handling, processing and exporting goods from the United Kingdom in accordance with Emirates Delivers’ own Terms & Conditions – see www.emiratesdelivers.com/terms.
2.5 Bicester Village plays no role in, and is not responsible for, any agency relationship between the guest and Emirates. All obligations, authorisations and liabilities associated with that agency relationship are solely between the guest and Emirates.
3. Emirates Delivers Account
3.1 To use the service, guests must: • register for an Emirates Delivers account; and • accept Emirates Delivers’ own terms and conditions.
3.2 Bicester Village does not: • control the Emirates Delivers platform; • set Emirates Delivers’ pricing; • accept responsibility for Emirates Delivers’ performance; or • check, validate or submit documentation on behalf of guests and assumes no responsibility for delays or refusals caused by incomplete or incorrect documentation.
4. Transfer of Risk and Responsibility
4.1 Risk in and responsibility for goods passes once the goods are delivered to the Emirates Delivers UK warehouse.
4.2 From that point onwards: • all delivery tracking, enquiries and claims must be made directly with Emirates Delivers; and • Bicester Village has no responsibility for loss, damage, delay, mis-delivery or non delivery occurring after that hand off.
4.3 Guests understand that Emirates may refuse to process, hold, delay or withhold release of any shipment pending payment of outstanding shipping charges, duties, taxes or other fees owed by the guest.
5. Duties, Taxes and Charges
5.1 Guests are solely responsible for: • all international delivery charges; • all customs duties, import taxes and other governmental charges; • compliance with all applicable import laws and regulations in the destination country; and • providing accurate and complete invoices, merchandise values, export declarations and all other documentation required under applicable export and import laws or under Emirates Delivers’ policies.
5.2 Bicester Village does not provide advice on customs, duties or taxes and does not collect such amounts.
6. Eligible Destinations
6.1 The Emirates Delivers service facilitated at Bicester Village is available only to selected international destinations, as determined by Emirates Delivers from time to time.
6.2 Destination availability may change and is not guaranteed.
7. Product Restrictions
7.1 Guests acknowledge that they are responsible for ensuring that none of the categories of products being shipped fall within those that are restricted by Emirates Delivers including (without limitation): • fragrances; • watches, jewellery, precious metals and stones; • products made from restricted or exotic materials; • hazardous, dangerous or illegal goods; • restricted wildlife, animal skins and certain animal origin materials; • controlled substances and other prohibited items under applicable law; • items listed in the Emirates Delivers “We Will Not Carry” or restricted goods policies.
7.2 Additional restrictions may apply under Emirates Delivers’ policies or local import laws.
7.3 The Emirates Delivers service must not be used to ship goods with a total value exceeding £10,000 in any single transaction or shipment.
8. Returns
8.1 All returns remain subject to the individual brand’s return policy.
8.2 Where goods remain at the Emirates Delivers UK warehouse and have not yet been exported, Emirates Delivers may (subject to its own terms) facilitate a return to Bicester Village.
8.3 Once goods have been exported, any return shipping arrangements and costs are the guest’s responsibility.
9. Liability
9.1 To the fullest extent permitted by law: • Bicester Village accepts no liability for international delivery services provided by Emirates Delivers; and • Bicester Village makes no warranties or representations as to delivery times, customs clearance, or successful delivery.
9.2 Any claims relating to international delivery must be pursued directly with Emirates Delivers and Bicester Village’s liability remains limited solely to its facilitation role prior to hand off to the Emirates Delivers UK warehouse and is subject to the liability cap stated in clause below.
9.3 To the fullest extent permitted by law, Bicester Village’s total aggregate liability to a guest arising out of or in connection with the Emirates Delivers service (whether in contract, tort or otherwise) shall be limited to the lower of: (a) £250 per transaction; or (b) the value of the relevant goods at the point they are delivered to the Emirates Delivers UK warehouse (up to a maximum of £10,000).
10. Data Sharing
10.1 Limited guest information may be shared with Emirates Delivers solely to enable the operation of the service.
10.2 Emirates Delivers processes personal data in accordance with its own privacy policies.
11. Governing Law
11.1 These Terms & Conditions are governed by and construed in accordance with the laws of England and Wales.
