CHRISTMAS HAMPER DRAW FOR MEMBERS OF MEMBERSHIP WITH A MINIMUM OF THREE PURCHASES IN ONE DAY AT LA ROCA VILLAGE

The following terms and conditions apply to all Membership members participating in this La Roca Village draw:

  1. Organizer: The organizer of this draw is Value Retail Management Spain, S.L.U., with NIF B-60.689.486 (hereinafter referred to as the "Organizer" or "La Roca Village"), the entity managing the La Roca Village shopping center (the "Village"). The Organizer can be contacted at its registered office at La Roca Village, La Roca del Vallès, C.P. 08430 (Barcelona).

  2. Draw Regulations: The following rules govern the draw (the "Rules" and the "Draw"), which is exclusively for Membership members who make a minimum of three (3) purchases or transactions at three (3) different establishments or boutiques within the Village, on the same day. The participation period will run from December 1 to December 24, 2024 (the "Period") as part of the Christmas campaign.

  3. Participation Requirements: To participate, Membership members must:

  • Scan their purchases made on any day within the Period at any of the boutiques or dining establishments of the Village equipped with scanners (excluding “Starbucks,” which is excluded from this promotion). Unscanned purchases will not be counted under any circumstances.
  • Be previously registered in Membership or register at the time of making these purchases.
  • Be registered in Membership and have consented or consent at that moment to receive communications by email from the Organizer. Please note that without this consent, the customer will not be able to participate in the promotion, even if they are registered in Membership.
  • Once the above conditions are met, the customer will receive an email confirming that their purchases have been successfully registered and that they are eligible to participate in the draw. The customer must confirm their participation by clicking on the option provided in the email. Only once this confirmation is received will the customer officially become a participant.

  1. Draw Date: The draw will take place after the Period ends, specifically on December 27, 2024.

  2. Prize: The prize consists of a hamper of products sold in the “Taste of Christmas” boutique at the Village (the “Hamper”), which includes the following products:

Selección del ganador/a: El ganador/a será elegido de manera aleatoria mediante la plataforma random.org. El ganador/a recibirá una notificación por correo electrónico confirmando que ha ganado el Sorteo. El ganador/a deberá responder al correo proporcionando sus datos de contacto (nombre, apellidos, domicilio, teléfono fijo y/o móvil, DNI, y dirección de correo electrónico) y se le indicará el lugar de recogida del premio. El plazo para responder y facilitar los datos será de siete (7) días naturales desde el envío del correo. En caso de no recibir respuesta o si el ganador/a renuncia expresamente, el premio quedará desierto.

Condiciones del Premio: El Premio no puede ser transferido, canjeado por dinero en efectivo ni cambiado por otros premios, ni siquiera de menor valor.

Exclusiones del Premio: El Premio no cubre ningún concepto no especificado explícitamente, incluyendo, pero no limitado a:

Dietas; Traslados; Tasas y tributos, incluidos aquellos derivados del premio y la tasa turística. Plazo de recogida: El plazo máximo para recoger el Premio será hasta el 31 de enero de 2025. Si el ganador/a no lo recoge dentro de ese plazo, perderá su derecho al Premio y este se considerará desierto. El ganador/a deberá presentar su identificación (DNI, pasaporte, y/o carné de conducir) al personal de Concierge Services del Village para poder recoger el Premio, y deberá firmar una carta de recepción del mismo.

Exclusión de Participantes: No podrán participar en este Sorteo las siguientes personas:

Menores de 18 años; Socios, directivos y empleados del Organizador, de La Roca Village, Las Rozas Village, las empresas del grupo de The Bicester Collection, agencias involucradas en la promoción, proveedores y colaboradores directos o indirectos, así como sus hijos y familiares directos. En caso de que resultara ganador/a una persona de las mencionadas anteriormente, el Organizador podrá descalificar al participante y retirar el Premio por no cumplir con los requisitos de participación. Cualquier intento de fraude podrá ser perseguido legalmente por el Organizador, quien se reserva el derecho de iniciar acciones legales para reclamar indemnización por daños y perjuicios y otros derechos que le asistan. En ese caso, el Sorteo será repetido para seleccionar un nuevo ganador/a.

Exoneración de responsabilidad: El Organizador no se responsabiliza por la participación fraudulenta de terceros ni por malas prácticas ajenas al Organizador durante la promoción y desarrollo del Sorteo.

  1. Selection of the Winner: The winner will be chosen randomly using the platform random.org. The winner will receive a notification via email confirming they have won the draw. The winner must respond to the email with their contact details (name, surname, address, phone number, ID card, and email address), and they will be provided with the location for prize collection. The response deadline is seven (7) calendar days from the email notification. If no response is received or if the winner expressly declines, the prize will be considered void.

  2. Prize Conditions: The prize cannot be transferred, exchanged for cash, or substituted with other prizes, including those of lesser value.

  3. Exclusions from the Prize: The prize does not cover any concept not expressly specified, including, but not limited to:

Meals; Travel expenses; Taxes and duties, including those related to the prize and the tourist tax.

  1. Collection Period: The maximum time to collect the prize will be until January 31, 2025. If the winner does not collect the prize within this period, they will forfeit the prize, and it will be considered void. The winner must present identification (ID card, passport, and/or driving license) to the Concierge Services staff at the Village to collect the prize, and will be required to sign a prize receipt form.

  2. Exclusion of Participants: The following individuals are not eligible to participate in the draw:

Those under 18 years of age; Members, executives, and employees of the Organizer, La Roca Village, Las Rozas Village, companies of The Bicester Collection group, agencies involved in the promotion, suppliers, and direct or indirect collaborators, as well as their children and immediate family members. If an ineligible person wins, the Organizer may disqualify the participant and revoke the prize for not meeting the participation requirements. Any attempt at fraud may be legally pursued by the Organizer, who reserves the right to take legal action to claim compensation for damages and any other rights it holds. In this case, the draw will be repeated to select a new winner.

Exemption from Liability: The Organizer is not responsible for fraudulent participation by third parties or improper practices by others, which are outside the Organizer's control, during the promotion and draw process.

  1. Force Majeure: The Organizer will not be responsible for cases of force majeure or for acts that are not directly attributable to them, which may prevent the winner from enjoying all or part of their prize. The Organizer will not accept responsibility for incomplete participations due to technical failures, computer or software malfunctions, or any type of satellite, network, or server failure.

  2. Substitution of Prize: The Organizer reserves the right to substitute the prize with an alternative of equivalent or higher value if necessary due to circumstances beyond the Organizer's control.

  3. Acceptance of Terms: By participating in the draw, participants fully accept these terms and conditions, indicating that they have read and understood them and agree to their full content without reservations or limitations. Modification or Cancellation: The Organizer reserves the right to modify or cancel the terms and conditions of this draw at any time and commits to communicate any new terms, conditions, or definitive cancellation if applicable. Specifically, if the Village must be closed to the public due to force majeure, preventing the draw from taking place, the participant cannot make any claims against the Organizer.

  2. No Guarantees: The participant acknowledges and accepts that the Organizer does not provide any guarantees regarding the prize awarded in the draw.

  3. Taxation: In compliance with applicable legislation, if relevant, the Organizer will retain and remit the corresponding Personal Income Tax for the winner and will report the prize in the appropriate tax forms. Any tax implications related to the prize for the winner will be their responsibility, and the Organizer will be exempt from any liability in this regard.

  4. Publicity and Image Rights: The winner agrees and authorizes the Organizer to publish their name and/or image while collecting the prize on the Organizer's website, social media platforms, and any other commercial, advertising, or media outlets (internal or external) the Organizer may use. This authorization is granted exclusively for the purpose of announcing the draw results and is non-exclusive and non-transferable. The winner commits to reasonably participating in any subsequent promotional initiatives requested by the Organizer.

  5. Jurisdiction: The scope of the draw is limited to the territory of Catalunya. These terms are governed by Law 15/1984, of March 20, concerning gambling, and Decree 240/2004, of March 30, which approves the catalog of authorized games and bets in Catalunya, along with applicable Spanish law. Any violation of these terms by the participant will result in their immediate disqualification and loss of the prize.

  6. Disputes: Participants and the Organizer agree that any disputes arising from the interpretation or execution of these terms will be subject to the jurisdiction of the courts of Barcelona city and their higher courts.
