LA VALLEE VILLAGE PERSONAL SHOPPING SERVICE
The following terms and conditions shall apply to Guests’ use of the personal shopping services at La Vallée Village (“you/ your”).
Definitions

“Value Retail” or “we” designates VR Services SNC, company providing the Service;

"Personal Shopper(s)" means a member of the Value Retail staff or a service provider chosen by Value Retail and whose mission is to assist you in the selection and purchase of products as part of the Service.
Personal Shopping – Contractual relationship

“Personal Shopping” is a service which provides guests with help and assistance of a personal shopper to purchase clothing and accessories, either by accompanying the guest whilst shopping in La Vallée Village boutiques or by shopping on behalf of the guest.

To take advantage of the Personal Shopping services, you must book an appointment with our personal shopper via the Whatsapp Business application by sending a message, an email or a phone call (more detail here : https://www.thebicestercollection.com/la-vallee-village/fr/service/personal-shopper/ a minimum of 48 hours before you wish to use the Personal Shopping services at La Vallée Village to confirm the booking.

The Service might be provided by the Personal Shopper by accompanying you during your visit to La Vallée Village, offering a guided tour of the Village, providing you access to our VIP lounge, giving you the benefit of a priority queuing or other advantages that he deems appropriate given your needs and the availability of the products.

This Service can also be provided remotely, the Personal Shopper organizing the presentation of the products in a virtual way, by sending you photos or videos of the products selected.

Once the selection of products has been validated by the Client, the Personal Shopper will be assisted by one of the employees of Value Retail who will finalize the order, the payment of the products and the shipping costs if required.

The Personal Shopper may use remote communication - telephone, video call, e-mail or instant messaging or other remote method or a combination of various methods (the "Virtual Services"), in order to provide you with a distance shopping experience of quality and present you in a pleasant way the products selected for you.

The Service will be set up as soon as Value Retail accepts the mandate given by the Client to Value Retail through the Personal Shopper in order to proceed, through the Service, to the purchase of products in the name and on behalf of the Client, in accordance with these T&Cs, and once a suitable date has been found and an appointment made through Whatsapp Business.

On arrival at La Vallée Village, you must present your booking confirmation at the your name. You will then be entitled (subject to availability) to receive the Personal Shopping services.

Personal Shopping services are only valid on the date and at the time of the booking confirmation.
Mandate
- By digitally signing these T&Cs or confirming your acceptance (tickbox), you designate Value Retail, directly or through our Personal Shopper, to be your non-exclusive representative to:
a. purchase the products that you have selected for your account and in your name from the Village Brands; and
b. enter into agreements with shipping companies for the delivery of your purchases; and
c. for any purpose reasonably necessary, carry out your instructions in connection with the above.

You authorize us to mention that we are acting as an representative on your behalf, and to disclose your identity to the Brands and to shipping companies.

We will act with reasonable skill and care, but will give no guarantees and will have no obligation of result as to the quality of the Service or of the Virtual Services.

We will endeavor to respond to all Service related inquiries and instructions within 48 hours.
Purchases

During your Personal Shopping appointment, a Personal Shopper will assist you to enable you to purchase products.

These purchases will be facilitated by the Personal Shoppers but will be made in the your name on behalf of you. You will, therefore, be the direct purchaser of the products that you have instructed the Personal Shopper to purchase on your behalf.
Once you have made your selection of products with the help of our Personal Shopper, we will send you an email (i) acknowledging receipt of the exact details of your order made in accordance with the present T&Cs, (ii) providing you with a secure payment link (Saferpay) to enable you to pay for your entire order and, (iii) confirming the total amount to be debited from your account for these purchases, and (iv) if required, the additional shipping costs. made your selection of products with the help of the Personal Shopper, La Vallée Village will send an email: (i) acknowledging receipt of the exact details of the order made by you in accordance with these terms and conditions; (ii) providing you with a secure payment link to enable you to pay for the entire order; (iii) confirming the total amount to be debited from your account for the purchases; and (iv) if applicable, the additional shipping and import costs associated with the purchases.
- Once you have concluded the payment process for your purchases, the Personal Shopper will finalise the purchase of products selected and paid for by you. Delivery details of the purchases will then be communicated to you.
Products

As part of the Personal Shopping Service, the Personal Shopper may offer you to assemble a personalized selection of products that you will view, select from and then purchase, depending on your interests or the brief provided to the Personal Shopper.

With regard to Virtual Services, the Personal Shopper will endeavor to provide quality images and/or videos of the products. These may be professional images provided by the Brands themselves or images that the Personal Shopper or other Value Retail employees will take from the Products - in some cases during a live streaming call with you. The quality of these images may vary and if you are concerned that the image quality will affect your ability to select the right Product for you, you should let us know as soon as possible.

In many cases, the Personal Shopper will be able to borrow or reserve products in your preferred style and size from Brands. However, the Brands' stocks are limited. Promoting a Product or suggesting a Product to you does not constitute a guarantee or a commitment on the part of the Personal Shopper or on our part, and its availability can only be confirmed at the time of the actual purchase.

After the purchase, the product sent will be the one presented to you, it being understood that the colors may have been altered by the Virtual Services, which the Client accepts.
The Personal Shopper will seek to borrow or reserve products in your preferred style and size. However, the boutique stocks are limited. Promoting a product or suggesting a product to you does not constitute a guarantee or a commitment by the Personal Shopper on the part of La Vallée Village, and product availability can only be confirmed at the time of the actual purchase.
- Delivery timescales discussed with the Personal Shopper are estimates in light of usual postal service times. Personal Shoppers cannot warrant or guarantee that products will be sent out by a specific time and/or received at a particular time or for a specific event, even if you informed the Personal Shopper that you wanted the products for that event.
Returns

You may return purchases directly with the boutiques (whether due to defects or otherwise) in accordance with the return and exchange policies specific to each boutique, the details of which will be on the receipts of the purchases.

Each boutique is a separate company with its own return, refund and exchange policies. La Vallée Village cannot guarantee that a boutique will provide reimbursement for the returned purchases.

The boutiques may affix labels or other markers to certain products to prevent their use. The boutiques will be entitled to refuse returns or refunds of products where the label or marker has been detached or where the products have been soiled by wear or use, partially used (for example, cosmetics) or mixed or contaminated with other products or materials. By removing any label or other markers, you waive any right to return the products.

Boutiques may not accept returns of products shipped outside of France depending of each national political and geopolitical context.
General

Personal Shoppers that carry out the Personal Shopping services aim to make your shopping experience at La Vallée Village as pleasant as possible by helping you select products that will suit you. Personal Shoppers will use reasonable efforts to achieve this but cannot guarantee that you will be satisfied with every purchase. You should report any concerns to the Personal Shoppers.

Except to the extent applicable law limits or excludes a party's ability to limit its liability, we will not be liable for any loss or damage, however serious and under any legal principle, including contract, tort (including negligence) or other or a third party arising out of or in connection with:
a. inappropriate advice from the Personal Shopper; or
b. the selection of inappropriate products by the Personal Shopper with regard to your request, situation or purpose.

La Vallée Village is subject to certain legal regulations. La Vallée Village suppliers, particularly suppliers related to financial services such as credit and debit card payment agents like Saferpay, are required to, or require La Vallée Village to, undertake certain identity and fraud checks. La Vallée Village may need to hold copies of documents relating to the identity and/or fraud checks, and/or provide them to the suppliers who need to make such checks or who conduct checks on behalf of La Vallée Village, in which case La Vallée Village shall use reasonable measures to keep copies secure.

In some circumstances, La Vallée Village may ask you to provide formal proof of identity, residence or address and/or conduct checks against denied persons lists, money laundering checks, financial credit and fraud checks. If you decline to partake in such checks or fails any checks, La Vallée Village may end the Personal Shopping services and decline to provide any further services. Nothing in these terms and conditions excludes or limits liability which cannot, by law, be excluded or limited.

We aggregate liability arising out of or in connection with these terms and conditions and the Personal Shopping services shall not exceed the greater of: (a) 100% of our costs incurred for the Personal Shopping Service, (b) 10% of the value of products purchased by you in the previous 60 days or (c) € 1,000.

We aggregate liability arising out of or related to these terms and conditions and the Personal Shopping services with respect to confidentiality, data protection law, or for damages resulting from a breach of these terms and conditions and/or the law shall in no circumstances exceed a total of 5,000 €.

We, the managing company of La Vallée Village, process your personal data for the purpose of registering you for Personal Shopping and managing the service during your visit to La Vallée Village.
